DMCA Takedown Notice Policy - CHATAN GROUP INDIA
This document outlines the policy of **CHATAN GROUP INDIA** regarding copyright infringement claims and the procedure for submitting a Digital Millennium Copyright Act (DMCA) Takedown Notice.
As a platform that hosts user-generated content (chat messages, shared links), we adhere to international standards regarding intellectual property rights. We will respond promptly to valid notices of alleged copyright infringement.
1. Designated Agent for Notifications
All notifications of claimed copyright infringement must be submitted to our Designated DMCA Agent at the following email address:

2. Requirements for a Valid Takedown Notice
To be legally effective, a notification of claimed infringement must be a written communication that includes substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (e.g., the specific URL/link in the chat).
- Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Takedown Procedures
Upon receipt of a complete and valid DMCA Notice, **CHATAN GROUP INDIA** will take the following steps:
- Remove or disable access to the infringing material identified in the notice.
- Notify the user who provided the content (where possible, given the anonymous nature of the chat) that the content has been removed or disabled.
- Maintain a record of repeat infringers and terminate service to users who are found to be persistent violators of copyright law (see Section 4).
4. Policy Regarding Repeat Infringers
We reserve the right to immediately terminate the accounts (or permanently ban the temporary User ID/IP Address) of users who are determined to be **repeat infringers** of copyrighted material. Due to the anonymity of our service, determining repeat infringement will be based on IP addresses or persistent session IDs, when available.
5. Counter-Notice Procedure
If you believe that the material removed or disabled is not infringing, or that you have the authorization to use the material, you may send a counter-notice to the Designated Agent (dmca@chatangroup.com) containing the following:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in New Delhi, India, and that you will accept service of process from the person who provided notification of the alleged infringement.
